That is pretty common ... I have buddies that hunt up there and they are always having trouble from game wardens , law enforcement and the locals . Most of the time if they have to park off the side of the road to access their lease , which they hardly ever do any more , they'll back their truck towards the woods , so the locals can't easily read the Louisiana tags . This is nothing new . I've known several people over the years that have gone through the same thing . Windows broken in their vehicles , camps broken into , items stolen , firewood constantly stolen . The list goes on . Anything that resembles La. hide it . Get you an ole miss baseball cap and rub it in horse manure , you'll look more like you belong there and won't be harassed as much . The sheriff deputy wasn't being a dummy . He probably already saw your plate on your truck and was looking for you when he found you .
get the badge number from the ticket of the wildlife agent and report him to the main office in writing and ask for a return response.But they do have the right to ask and search. you have to have in writing permission to be on a property. you are an outsider there so follow all the rules as they will always hassel you. won't do you any good to take it to the local court as you will always lose, just pay the ticket and learn a lesson. We need the wildlife agents but they also need to follow the law and not harress, just report them.
law enforcement in most my experiences are typically very unknowledgeable about how the laws are written and what the statute actually entails. They think they know but really dont have a clue. You never want to argue with law enforcement because as all of you know that is pointless because they are always right. Just take what they give you and always take your case before the more educated and level headed DA.
I hunted in Miss for a few years and found the wlf agents a little out of hand. I guess they need the revenue and how better than someone from out of state. did you know the finds are double if from out of state. I now hunt in Alabama and most of the agents are friendly and courtious, haven't been harassed once in 5 years. In Miss it was a daily occurance.
And to clarify it was the Sheriffs Deputy that was a complete douche. He came out gun drawn with a boner, saying it was a good thing i stopped cause he was trained to run over people on 4 wheelers if they try to run. He was a complete idiot to be honest with you. I witnessed him do several things that could have potentially put his life in danger if i would have been a real threat. I even told him that he should be more careful because he never knows who he is pulling over, which im sure he took as 'back talk'. The Game Wardens were very polite its just that law enforcement never seems to understand the laws they LOVE to enforce. AND TRUST ME I LOVE THAT THEY HAVE NO CLUE! They told me it was illegal to bait hogs because they saw hog bait on my bike which is incorrect. They gave me a hunting from a public road ticket along with the trespass ticket which at the time i thought i was guilty of even though i didnt know i was on a public road. 1st of all a trespass ticket and a hunting from a public road ticket contradict each other. YOU CANT TRESPASS ON A PUBLIC ROAD!!! But truth be known that law can only be broken during deer or turkey season calendar dates and also the law states that hunting from a public road applies to having a loaded firearm on a public road, but it clearly states that a 'firearm' does not apply to a handgun. I had a loaded 22 mag revolver. So I have 2 ways to get out of that ticket. These are Mississippi laws, La laws can be and probably are different by the way.
Im not totally sure but I think all of this started years ago over the out of state hunting liscence prices between miss and La. When La would go up miss would go up , back and forth . So during hunting season miss has the upper hand and can kind of abuse the out of state La. People and La can hit them back during the summer for fishing .
Miss has another lil trick they pull ... Sometimes they road block all the back roads going back to La. on sun evenings and check ice chest for venison without being legally tagged . So beware ! They will get you .
...more people disappeared in the 40's and 50's in the Devils Swamp than anywhere else in Louisiana and Mississippi...even the Spanish Trail cutters went around it...It's a mysterious place of peripheral movements and weird sounds that gives you the feeling that 'something' is watching you !!!...(even slow old wabbits don't go in there without a Ladner or Bourgeois guide)...cheer/cheers
Wouldn't proof that you were on your own lease be grounds for not getting fined for trespassing when you take it to court? I would try to go that route because if it was indeed a public road that is what you should have been ticketed for.
Do you have a lawyer. My experience says that even if you are right the judge is just going to fine you anyway. Whereas if a lawyer gets up there and says the same thing the judge will go by the actual laws.
Choupic is right, in late '60's miss. raised there non-residents fee to the unheard of price of $60, more in line with the license costs of western states. Since they had a recipricol agreement with la. over islands in the miss. river la. felt the need to retaliate and it went downhill from there.
Wall Hanger-I had receipt of payment for the lease in my truck (which IMO is as good as some letter)...not good enough.

Mike-I would need to study MS 63-7 a little further but I dont think it is against the law to operate a 4 wheeler on a public road in MS excluding interstates and State Highways. And when you go to court on your first appearance for a citation you will only be speaking with the DA or one of his assistants not a judge. If you chose to plea not guilty then you will go before a judge, in which then you would most likely benefit by having a lawyer.
It is not illegal to operate an ATV on a public road (excluding interstate and state highway) in Mississippi with a valid drivers license or ATV safety course certificate and if under the age of 16 along with the ATV safety certificate the under 16 year old is required to wear a helmet. So, therefore I could not have been legally issued a ticket for operating my 4 wheeler on a county road!
I would go to the district attornies office with your payment for your membership and contact number for the board member and plea your case before your date to pay ticket. He may dismiss the tresspassing charge.It seems like thay are trying to make a quick buck off of you its bull good luck to you
Sounds like they were unreasonable...i used to own a kennel and i used to have to go to Mississippi alot doing breedings and one night i was driving my lexus and stopped at an old vacant store to make a phone call to the breeder i was going to see to make sure i was on the right path...a police officer came and was very hostile. If i was u i would get a written letter from the club board members, get them to call and help u get that ticket beaten...if the sheriff didnt write u a ticket for operation of an atv on a public road then ur ticket is a bunch of bull. Mostly all the wardens in my area know me and i have the captain's personal number...did i mention i have family that works for la wlf ;) good luck bro
