blocked canal

i did do a lot of serching what the law states if it is a man made canal who buys the land can allso have ownership of the canal with the exeption if a oil company dug the canal and the state collected revenue off the minerals it would stay porerty of the state and open to the public.or if a permit was given to them by the state with out collecting any revenue it stays state property. called wild life and fisheries talked to them and he agreed it is the law on the books they can not block the canal so i asked him why they do not inforce it he could not give me a answer.land owner must prove a single person payed his own money to have the canal dug and have it recorded in court this law was singed by the govenor and a senator what good is laws if not inforced and why is wlf not inforcing it.

I want to be able to comment effectively on this, but I am having a hard time understanding what you're asking.

I can answer that comment, in two notes. Years ago, in the Leeville area, I encountered gated canals and canals that were posted, and had armed guards. I checked with the State and the Wildlife and Fisheries. This is what I was told. If there is a canal/bayou, or whatever you want to call it, and the waterway has one way in and another way out the waterway belongs to the State of Louisiana. Even if someone has the property on both sides leased. If it is a waterway with only one way in, and you have to come back out the same way, it is leased property. I was also told that we can't do anything about it, because the lessee will call the local Sheriff, and have you arrested, and they will win. I was told that in the majority of the leased sites, they are leased by wealthy individuals, and they have enough money to tie you up in court until you die, if you aren't wealthy too. That's one of the reasons I have been trying to win a $200,000,000 POWERBALL. SO THAT I CAN!!!! Now this was in the 1970's. Don't know if they changed anything. Hope this helps.

answer

the answer to your question is LOUISIANA POLITICS if you have the money you can do what you want, no matter what you can prove

Since you understood the OP's question, can you please summarize it for me? I'm certain the answer is simply 'politics', as it is for every question, but maybe we can be enlightened further if we all can understand the question.

TIA

ha

like i have said in the past I AM NO EXPERT, I JUST PLAY ONE ON THE INTERNET

but what i got from the o p is that he is tired of dealing with canals that are blocked off, probably some spots he used to fish in the past(i have had the same issue) i have posted the same question on here in the past, the answer i got for the similar question was that if the canal was man made then it can be posted by the owner in some cases even if the owner is no longer the owner, regular joe like myself can't fight this so i just leave it alone, and find another place to fish(most of the time)

my interpretation of the law was that if a waterway is effected by the natural tide then it is to be considered public waterway

i am guessing this is an old law that has been tweeked by people and lawyers and politicians to benefit themselves and to heck with the rest

Fish

If it is a canal thats part of the public water ways, marsh, etc. I usually just fish them anyway. I've had guys just drive right by me while I was fishing and I've had guys ask me to leave before. I don't know what legal grounds these guys had to ask me to leave, but i just politely picked up the troll motor and left to avoid any kind of confrontation. However, I was back fishing there my next trip. If I know that the canal was man-made with one entrance/exit, and on posted property, well I stay out of those. Just my 2 cents!

Lol

Man you are relentless . Gar fishing is a seasonal thing . Before Isaac we were getting ready to fish sacalait on into hunting season .

There are canals with gates over them , but it's been that way since I was born . It's hunting leases and they're man made canals and I try to abide by the law and not cross them .

But the situation these people face are totally different from this area . If it were me , and someone posted canals that I've fished all my life , I would be upset too .

Maybe since you are so intelligent you would enlighten these people on how to take steps as to fix this problem , instead of calling them dumb . Not everyone is as intelligent as you .
